Section 28.9 B on page35 of the 2005 book

When spearfishing for or in possession of federal groundfish or associated species as authorized under authority of Sectino 27.82(c)(4), in an area or during a season closed to the take of the species, no fishing gear except spearfishing gear may be aboard the vessel or non-motorized watercraft.

So if fishings closed to the hook and line and your spearing, dont have any rods on your boat.

Well, yeah, but there are many similar regs, like you can't have scuba gear on board when abalone are on board (though you may have scuba gear and abalone in your car...) You can't have salmon on board and a rod that's rigged with tackle that isn't salmon-legal, and you can't fish for salmon in water over 120' deep when rockfish are aboard... Lots of rules to keep you from getting mischevious.

So does anyone have a concrete answer for Sheephead in 2005 ????
Are they legal to take by spear all year?

Note:

Shore-based anglers are fishermen that fish from beaches, banks, piers, jetties, breakwaters, docks and other manmade structures connected to the shore.
Divers are spear fishermen entering the water either from the shore or from a boat or other floating object.
