IN TIDAL WATERS OF THE STATE IT IS LAWFUL:

1. between June 15 and December 31 of each year, for an individual to take or shoot fish, within specific seasons and limits established by the Department, with a spear gun and spear.

:( closed season for sprearing in MD, we have to wait for June 15.

VIRGINIA SPEAR FISHING RESTRICTIONS
Anyone fishing with a spear or gig in Virginia’s portion of the Chesapeake Bay,
the saltwater, tidal tributaries of the Chesapeake Bay, and Virginia’s Territorial
Sea needs a saltwater fishing license [Code 28.2 – 302.1].

It shall be unlawful for any person to harvest fish for commercial purposes by any method of spear
fishing. [Regulation 4 VAC 20-995-40].

It shall be unlawful for any person to spear or gaff any striped bass [4 VAC 20-252-30].

It shall be unlawful for any person to take, catch or possess any sturgeon [28.2 – 303].

It shall be unlawful to possess a lobster that has an outer shell that has been speared[4 VAC 20-110-30].

I am still looking for Delaware regs.

Do a search on the page for "spear" and it says it's legal for fishing with a spear, or speargun. I know that because we have speared up at the Breakwater and it's done regularly.

What do you say, Trident - a shore dive at the Breakwater on Sunday? If not, some dive training at St. Mary's or Calvert Cliffs looking for sharks' teeth, maybe.

I live in delaware and have recently got into spear fishing.... not being able to find any regulation online or on paper I called DNREC. Delaware actually dosent have any regulations on paper for spear fishing so they just follow there fishing laws for size and creal limits. This goes the same for fresh and salt water. Hope this helps!

DE has a great view that Rec. fishing is all the same. As for MD with a little help I would like to change the regs. on rock fish and the seasonal crap. I called on the June 15 thing and no one can remember why that is.

Does that mean there is no spearfishing in MD until 6-15?

ITS MY UNDERSTANDING THAT BEACH DIVE FOR SHARKS TEETH @ CALvERT CLIFFS PARK AREA IS OFF LIMITS TO DIVERS FROM SHORE. BOAT ACESS ONLY ALLOWED TO TOOTH GROUNDS. WADE
Check w/ Brass Anchor Scuba. They know the new rules.
