You can find them off shore on weedlines or any floating objects. They seem to really like buckets.

Lol theyre dumb as hell...don't need a spear I caught like a 5lb one with just a lobster net the other day. Most of the time you don't even have to leave the boat!

Ok well I was told by several people you can out of state waters. So here ya go...22lbs... Thank god for float lines.
I am going to make a few calls tomorrow and find out for sure what the rule is.

Outside of state waters (>3mi from coastline) it is NOT prohibited. Not stopping in state waters is a good idea if you do this.

Here's the real question: may the same be applied to snook? here's where you get conflicting info from within the FWC because too many get emotional over snook.

I asked the federal fisheries, not FWC, about snook. Their response is that if they do no have specific regulations regarding something then state waters rules get extended into federal waters.

In this case I think they already have regulations for permit etc that do not prohibit spearing.

While they have no regullation whatsoever on snook.

What if a speared snook stays offshore, i.e. it is grilled and consumed without re-entering state waters. No law against that. What you linked to above implies possession within Florida waters. From what I have read, you can be filleting a snook in federal waters and so as long it remains in federal waters, you have not violated any specific regulation.

Correction: they have CLARIFICATION on permit, thanks to John Herrerra who questioned them until they had to become more specific than the "state waters rules get extended into federal waters"...

The state ruling superceding the federal rule implies application of state laws for possession of federally harvested fish in state waters. You cannot show me where possession of speared snook in federal waters is against the law. I've already looked at all of these. Of course, none of this is worth going to court over. This is all food for thought. I have no interest in spearing soapfish, the same fish all these ding-dong columbia wearing inshore junkies would kill their grandmother over. Could you imagine the shitstorm if something like this were exposed and allowed via the loophole I am describing?

giant snook are in or on every wreck in less than 70 feet on the treasure coast, that I can guarantee. as for reds, not so much! If i'm not mistaken, state waters are 3 miles out, that will put you in 40 feet of water around here?

From time to time, but very seldom out deep. More occasionally in the 20-40 ft reefs a couple miles from the inlet. But in the same areas where I see the snook in the 80-120 ft depths, I rarely see redfish.

Simply because you have to deal with FWC when you return and some dont play so nice...right is right but if you have to go to court to argue a ticket the fish probably wasnt worth it.......

I do see redfish in the 80 ft range sometimes..

I have seen on a few occasions a dozen large red fish in 90-100 foot spots. they look so out of place when you see them out there to me.

If you guys actually did break any law by spearing them out of state or in state waters with pictures of it. They may knock on your door and say "Spearboard". Happened to me actually....:(

we were H & L fishing in 210' out of Ft Pierce and landed a 40+ redfish. we were surprised and disappointed at the same time.

The main ledge is more than three miles out and we see them there quite often.. The middle and outside loran ledge are more than three miles and you can find them there all the time..
