Sounds to me like this applies to if you find any dead fish, you can remove them from the water regardless of the regulations. I'm sure the kind FWC officer who inspects your catch and finds a spear hole in the 16 inch gag grouper won't believe your story of finding him already dead in the red tide and you were just cleaning up the ocean.

FWC makes snook, redfish temporarily catch-and-release only in areas affected by red tide:
