Bust at Monastery beach
There was a bust today someone spearfishing at the reserve.
I had a picture from my dash cam, but I should have stopped recording, by the time I got home the camera recorded over it. Anyway there was a CDFW and CHP at Monastery beach with the tailgate on his truck open and loaded with 5 to 8 pounders, the ones I could make out while driving looked like some kind of orange rockfish, they were not red like vermillion I counted at least 4, all the other fish were dark, also large 4 to 6 pounders. Most likely they were taken from a diver on scuba, looked like the reserve is producing some nice fish, maybe some more news will come out tomorrow. |

I remember sitting on the beach there waiting for my dad to finish spearfishing. They closed it before I was old enough to start spearfishing.
Why would somebody poach there when a half mile away is decent spearfishing not in the reserve? |

My friend scuba dives there and said he sees people fishing from kayaks right in the reserve almost every time. :\

Weird how you can dive a place with your buddies one year, someone extends the reserve boundary a couple coves, and next thing someone wants to bust your head open.

Exactly , and the resurve should have never been expanded in the first place . Most people you ask still don't even know that it is now a resurve

That's what I figured.
I tried doing some research on the penalty schedule for poaching in an MPA, but I didn't find anything definitive except for this: http://www.gc.noaa.gov/documents/gce...x-it_FINAL.pdf Per the above document, there's a flat rate penalty for up to 10 fish, but I'm not sure if there's a by-species penalty on top of the baseline penalty for fishing an MPA. I also saw some other judgments where repeat offenders were prosecuted by the state and given multiple years of probation and hefty fines. Anyone have anything more specific/comprehensive? |
