I spoke to Bahamian Marine Resources directly, and here is the deal:

The rules apply to foreigners either on their vessel or a rented Bahamian vessel. No Conch or Turtle period. All fish must remain whole until back at the dock. The 20# limit applies to the whole fish. Any 1 fish over 20# puts you in violation of the law if you are caught. Hawaiian Slings and Pole Spears are legal AS LONG AS YOU DECLARE ON YOUR FISHING LICENSE THAT YOU ARE GOING TO USE THEM. The bag limits remain the same. Make sure when you buy your fishing license that you make the man write on it that you intend to spear fish with a Hawaiian Sling or Pole. If you are on a Bahamian vessel with Bahamians on board the bag limits still apply to you but the Bahamians do not have any limits so any fish or conch would be theirs.

Nice thanks for the update. I'm glad I will still be able to take people out and not have the boat limited.... Although the law still doesn't make sense in that regard, but I'll take your word for it.

Jason... Why must you depress the sh*t out of me while I am at school, like being in freaking SC is not bad enough... So I guess the spring break trip over to shoot some nice fish is out of the question now. This is the worst news ever... Hey what’s the deal with the Boat Show, you still want me to come down.
