CDFG news release on gifting abalone.

Got this from the CDFG News release, so if you are gifted an ab be sure the tag is filled out correctly.

Question: If someone gifts abalone that are tagged but the tags are filled out improperly (or not at all), who gets the ticket, the person with the abalone or the original pickers?

Answer: Both individuals can be cited. The individual who took the abalone can receive a citation for failing to tag abalone or improperly tagging abalone. The individual who receives the abalone can be cited for unlawful possession of abalone that are not tagged or improperly tagged. (Fish and Game Code, Section 2002).

This is the one thing that comes to mind to me on this and that is most of the time the person that is reciving the "Gifted" abalone typically does not dive or know any thing about the regs and laws. Most of the people I have given it to never has had it before ! seams like they should go after the person who picked not that hard to track the tag back to the ab card and get the info from there and send a ticket in the mail.

Re: CDFG news release on gifting abalone.

That's exactly why I keep them all for myself......

My "gifting" is when you come over, and I cook it up for you.

Then they get you for constructive possession (saying it half in jest).

I'm not going to dive for abs again until I finish law school (and the water warms up).

I have a 7/5/4 XCel suit and I go into heat exhaustion in 48F water. I get a bit cold in a 4/3, so I bought a Yazbek 5mm and I'm just about right.

I'm a long time cold water surfer though, so if you're normally a warm water guy, 7mm might be the way to go. Results may vary, past performance is not a guarantee of future results....

Just to be clear... did you go into heat exhaustion while spearfishing or surfing?

I talked to a DFG guy last year just to make sure I was legal. I said I would like to dive for three one day and gift them to one of my kids, then get three more the next day for myself. He said "that's what I do", so that's what I do too.

And yes, too many rules to the point of being stupid. Especially when it seems that they target people that are just trying to do the right thing, but happen to make a simple innocent mistake.

Re: CDFG news release on gifting abalone.

Last time i gifted an ab,(i believe a DFG warden advised me to do this) i wrote a note stating who , the date and time i gifted them the abs, next time ill do the same but will also put the number of the ab card tag on the note also.
