Major battle tommorow.

Tommorow is the day of one of the bigger battles in the continuing Grouper war.
Tommorow afternoon the FRA/CCA lawsuit against the governments temporary rule will be heard before a federal judge in Ft. Myers.

If we win... it should be a MAJOR turning point in how things are done by those entrusted to manage our fisheries.

If we lose... it will still not be the end of the world however. We will have shown that we will not sit idly by while foolish decisions are made by foolish people.
We will have shown that the recreational community will sue.
We will also have ammo against the permanent rule if the Gulf Council decides to move forward with the permanent rules.
We will have also learned that if we Dont get involved early enough we will be steamrolled.

A special thanks go out to Webbers(Scott Weber) and MCJarret(Frank Anderson) who have spent litterally HUNDREDS of hours on this lawsuit for FREE!
These guys are freakin Awesome!

Many others have contributed to this battle and you all deserve a big thanks as well!

Lets all keep our fingers crossed that the Judge will be able to see through the NMFS dog and pony show.

Just briefly... Todays hearing in Ft. Myers Federal Court this afternoon... The FRA/CCA's Lawsuit against the Feds lasted nearly 3 hours when it was only supposed to last 1.
The Judge decided to hold off on his decision until possibly as late as Monday.
The judge appeared very interested in the case and asked a lot of questions to both sides.
Very tough to get a read on how it will go down but I remain optimistic about the outcome.

I would like to point out one thing the Governments lawyer said during yesterdays hearing which rubbed me the wrong way and should rub every single person who either wrote in or attended public input on the grouper issue.IMO

The lead government lawyer used the exact words "HECKLERS VETO" when speaking about it. Its on the public record.btw
Our lawyers reminded the judge and government attorney that far more people wrote letters and turned in public comment cards than the ENTIRE sample size of MRFSS estimates around the entire state of Florida!

Is this what our government thinks of OUR input!? "Hecklers Veto"!?

If you havent wrote a letter yet... I seriously suggest you write to your elected officials and tell them that if "you" are not heard... "they" will not have a job come time the next election rolls around.

I like that, that b*sta*rd works for us, THE HECKLERS. I wonder if we can get him fired from his, I bet, very lucrative government position. Or if he is a contractor, get it cancelled. I feel a letter to Hogarth coming.
